MyBidDomain.com Terms and Conditions of Use Agreement.

This is a legal agreement between all users of this site, Mybiddomain.com and the site owners, employees and affiliates. By using this site you agree that you fully understand and accept these terms and conditions. You also agree to abide by all of the information contained in this agreement. You must be at least 18 years of age to buy or sell items on this site. If you do not accept this agreement do not use our site or our services.

Registering for an account
Anyone who signs up for an account on Mybiddomain.com is referred to as a user. The information collected during the registration process is used either to buy or sell items on the site. If you will be buying items your shipping address will be given to the seller. All users’ usernames will be viewable by all viewers. Both buyers and sellers PayPal addresses will be used in the transaction process between buyer and seller as well as the transaction process between Mybiddomain.com and seller. If an account is unconfirmed for more than 14 days or if an account is inactive for more than 6 consecutive months we reserve the right to cancel the account. If you do not agree with these terms do not register for an account on our site.

Our Fees
We do not charge any buyer fees. Seller's are charged and agree to pay a listing fee based on their final selling price. Seller agrees to pay the listing fee to Mybiddomain.com within 48 hours of the auction end time. If the seller does not pay Mybiddomain.com our listing fees within a maximum of 7 days, we have the right to cancel your account, ban you from further use of the site and/or take legal action to retrieve our fees. If the seller does not sell the item no fees are charged. Sellers do have the option to charge a shipping fee, based on their location and the purchaser's location. Mybiddomain.com does not collect any credit card or banking information from its users. All of our fees are paid and collected directly from pay pal. If you do not have a Pay Pal account you cannot sell items on our site. It is up to the sellers and buyers to make shipping and payment arrangements within 48 hours after the auction have closed. Mybiddomain.com has the right to change, add or delete any and all fees, at any time and for any reason. All fees and bids are in U.S. dollars.

Sales Tax
Mybiddomain.com does not charge sales tax. It is the seller's responsibility to check with an accountant to determine if sales tax should be charged on their item. If it is determined that sales tax must be charged, seller must specify that in their item description. If sales tax must be charged and the seller does not specify that in their item description, the buyer is not obligated to pay the sales tax fee.

Insurance
Sellers are required to keep insurance on their items until they have been received by the buyer. Once the buyer has received their item/s it is their responsibility to insure their items as they deem necessary.

Auctions and Bidding
Mybiddomain.com is strictly a venue; we are not a traditional auctioneer. We simply provide a service to allow our users to bid, buy and sell items via the internet, using an online auction. Mybiddomain.com is not involved in any of the transactions between buyers and sellers. However, we may interfere if a dispute is made. Our auctions are held on Tuesdays and Fridays, opening at 8:00 a.m. EST and closing at 8:00 p.m. EST. If you are in a different time zone and bidding on an item it is your responsibility to be aware of the correct time. Mybiddomain.com may at any time, but with good reason open auctions early or close auctions late. We are not responsible for any internet or computer problems or interruptions that you may encounter, even those that may affect the sale of an item. By using our site to buy or sell an item you agree that you are entering into a legally binding contract and therefore agree to pay any and all fees associated with your account. The seller cannot bid on their own items, but they are given the option to put a minimum starting price on their item when they post it, so as to protect their interest. You cannot reverse, change or remove a previously submitted bid. All bids are final! All sales are final!

Posting and selling items
Mybiddomain.com has the right to monitor all user accounts. We may at any time ban users who we believe are creating problems, misrepresenting information, or who are causing or may cause current or potential legal liabilities. We also reserve the right to ban users who do not adhere to this agreement, who do not follow through with a sale or purchase, who sell prohibited (listed at the bottom of this page) or illegal items, or who exhibit bad, harmful or offensive behavior (bad, harmful or offensive behavior is determined by Mybiddomain.com). In addition to banning users we may also take legal action if we deem it necessary. Mybiddomain.com is not responsible for any information, pictures or content posted by its users. We will however do our best to monitor the site and its contents. All items listed for sale are viewable by all audiences, including those who are not registered users. Please be aware that individuals under the age of 18 may browse our site and listings, so use caution and professionalism when posting your items up for bid. Users who do not follow these terms may be banned or held legally accountable. Please Note that Mybiddomain.com has the right to reject or remove any listings that we feel are inappropriate, illegal or is on our prohibited items list.

Disputes
As previously stated Mybiddomain.com is only a venue, we are not involved in the transaction process between buyer and seller. Buyers rely solely on the description and pictures (if applicable) posted by the seller, to determine if they want to bid on an item. It is the sellers’ responsibility to post accurate, complete and honest descriptions of their items. Both buyer and seller are obligated to complete the transaction process. Within 48 hours of the bidding closing on an auction buyer and seller must make shipping and payment arrangements. Mybiddomain.com does not have a policy on shipping or payment terms, time limits or arrangements. Mybiddomain.com understands that disputes may arise relating to the posting of items, the selling of items or the purchasing of items. It is first up to the buyer and seller to try to come to an agreement if a dispute is made. If they cannot resolve the matter then Mybiddomain.com and its owners will work to settle the dispute. In the case that Mybiddomain.com does become involved in any disputes, both buyer and seller are giving Mybiddomain.com full rights to collect any information they deem necessary to resolve the matter. Both parties will then accept Mybiddomain.com's final decision and the dispute will be closed. In resolving any matter or disputes we have the right to enlist any legal or professional advice.

Warranty
All bids are final! All sales are final! All items are sold as is and with no warranty. Mybiddomain.com, its employees and its users disclaim any implied warranties of any kind, including those of title, merchantability, fitness for a particular purpose and non-infringement. The above disclaimer may not apply to everyone, as some states do not allow the disclaimer of implied warranties. Mybiddomain.com does not know the condition of any item and is not responsible if the item does not meet the buyers’ standards or expectations.

Release
Mybiddomain.com, its employees, or its users will not be held liable for any damages of any nature resulting from (1) the use of this site (2) the items sold on this site or (3) the contents thereof. We will not be held liable for any injuries to person or property resulting from (1) the use of this site (2) the items sold on this site or (3) the contents thereof. We will also not be held liable for any defects or any product liabilities on any items sold on this site. In addition, Mybiddomain.com, its employees or its users will not be liable for any damages (either monetary or physical) caused from or related to the use of or inability to use this website. The total liability of Mybiddomain.com to you for all damages, losses and causes of action arising from this agreement or your use of the site and the service, shall not exceed $100.00 one hundred U.S. dollars. Be aware that Mybiddomain.com may be unavailable at any time for site maintenance and updates. No person warrants that this site will be uninterrupted or error free. It is possible that this site may contain errors, outdated information, omissions and inaccuracies; we will do our best to prevent this from happening. Mybiddomain.com and its owners can make changes to the site at any time and without notice, including changes to fees, policies, terms and conditions, and site layout and content. Although they are required to we do not guarantee that our users will abide by the terms and conditions set forth in this agreement. We do not have any control over the quality, safety, or legality of the items bought or sold. We do not have any control over the truth or accuracy of the listings, the ability of the sellers to sell the items, or the ability of the buyers to buy the items. We cannot guarantee that a buyer or seller will complete a transaction. If you do not agree with and accept these terms and conditions do not use our site.

Indemnity
You agree to defend, indemnify and hold harmless Mybiddomain.com and all of its affiliates from claims, demands, damages and losses both actual and consequential, known and unknown, suspected and unsuspected, disclosed and undisclosed arising from your breach or violation of this agreement and its contents, your breach or violation of this site and its contents or any disputes or damages caused from your use of this site.

Consent to suit in Michigan, Kent County
In the event of any legal proceedings arising from this contract or from the auction in connection therewith, buyers and sellers consent to being subject to the personal jurisdiction of the courts of the State of Michigan in Kent County. Furthermore all users agree that the laws of the State of Michigan shall govern this agreement and the users’ transaction hereunder.

Privacy
We have the right to monitor all users accounts, including any messages sent between buyers and sellers via our website. We do not sell or distribute your personal information in any way to third parties. Your information is used strictly for Mybiddomain.com and is securely encrypted. We may use your information to perform surveys or request feedback aimed at improving our services. To close your account you must log out. Your password protects your account, make it easy to remember and keep it in a safe place. Your information is stored and processed on computers located only in the United States.

In addition to the terms and conditions set forth in the above agreement, the following is a list of conditions that must be adhered to by all of Mybiddomain.com's users:

• Do not post prohibited or illegal items.
• Do not use our site if you are not competent, if you do not understand and agree to these and the above terms and conditions, or if you are not at least 18 years of age.
• If selling an item you must make shipping arrangements within 48 hours of the auction end time.
• If purchasing an item you must make payment arrangements within 48 hours of the auction end time.
• You must pay My Bid Domain.com our fees within 48 hours of the auction end time.
• Do not post items for sale that have liens or secured parties.
• Do not copy, change, delete, sell, distribute or infringe on, any copyrights, trademarks or patents.
• You may not collect or attempt to collect any personal information from other users without their consent.
• Do not violate any laws

If you do not agree to the terms and conditions of this agreement do not use our site. By clicking "I agree", you agree to and understand the terms and conditions set forth in this agreement. By clicking "I agree" you agree to be held liable and accept full responsibility for your actions on this site. You also agree to accept the consequences if you fail to abide by the terms and conditions set forth in this agreement.

We have the right to add items to this list or remove items from it at any time and for any reason.

Any users who post or attempt to post any of these items will be banned from the site and Mybiddomain.com may enforce legal proceedings.
