This is a legal agreement between all users of this site, Mybiddomain.com and the site owners, employees and affiliates. By using this site you agree that you fully understand and accept these terms and conditions. You also agree to abide by all of the information contained in this agreement. You must be at least 18 years of age to buy or sell items on this site. If you do not accept this agreement do not use our site or our services.
Registering for an account
Registration on our site is free and allows users to view items up for bid, make watch lists and bid on items. Anyone who signs up for an account on Mybiddomain.com is referred to as a user. The information collected during the registration process is used to buy and sell items and for mailing addresses and verification purposes. All users' usernames will be viewable by all viewers. If an account is unconfirmed for more than 14 days or if an account is inactive for more than 6 consecutive months we reserve the right to cancel the account. If you do not agree with these terms do not register for an account on our site.
Our Fees
We do not charge any buyer fees. Seller's are charged and agree to pay a listing fee based on their final selling price, as well as a lot fee. Seller agrees to pay these fees by having them deducted from the final sale price of the items they sell. If the seller does not sell the item, the only thing they pay is the lot fee. Mybiddomain.com does not collect any credit card or banking information from its users. Mybiddomain.com has the right to change, add or delete any and all fees, at any time and for any reason. All fees and bids are in U.S. dollars. We do not accept credit cards or checks, all payments are cash only!
Sales Tax
Mybiddomain.com charges 6% Michigan sales tax on all sales. Check with the state of Michigan to see if your items are tax exempt.
Insurance
Sellers are required to keep insurance on their items until they have been sold. Once the buyer has received their item/s it is their responsibility to insure their items as they deem necessary.
Auctions and Bidding
Mybiddomain.com is not a traditional auctioneer. We simply provide a service to allow our users to bid, buy and sell items via the internet, using an online auction. Mybiddomain.com receives items from sellers, stores them at our location and does our best to sell them on our auction website. Every Friday from 8:00 a.m.- Noon, people can come view items, pick up and pay for items and drop off items. All other times must be by appointment. We charge sellers fees, but never charge buyers fees! Our auctions are held on Wednesdays and open at 5:00 a.m. EST and closing at 9:00 p.m. EST or 10 minutes after the final bid. If you are in a different time zone and bidding on an item it is your responsibility to be aware of the correct time. Buyers have 5 business days after the auction closes, to pick up and pay for their items. If items are not picked up and paid for within the 5 days we reserve the right to take ownership of the items and resell them. By bidding on an item you are entering into a legally binding contract and you agree to pay the price you bid in full at the time of pick up. Mybiddomain.com may at any time, but with good reason open auctions early or close auctions late. We are not responsible for any internet or computer problems or interruptions that you may encounter, even those that may affect the sale of an item. We also cannot be responsible for any issues that may arise with our site due to technical difficulty or server interruption. If something happens to the site during an auction day, we will hold that days auction on the following Wednesday. By using our site to buy or sell an item you agree that you are entering into a legally binding contract and therefore agree to pay any and all fees associated with your account. The seller can bid on their own items, so as to protect their interest. You cannot reverse, change or remove a previously submitted bid. All items are sold as is, with no warranty or no guarantees of condition or working order. All bids are final! All sales are final!
Posting and selling items
Mybiddomain.com has the right to monitor all user accounts. We may at any time ban users who we believe are creating problems, do not pick up or pay for items or who are causing or may cause current or potential legal liabilities. We also reserve the right to ban users who do not adhere to this agreement or who do not follow through with a sale or purchase. In addition to banning users we may also take legal action if we deem it necessary. Mybiddomain.com will only accept items that are in good condition and that we think are sellable. We will use our own discretion to determine if an item meets our standards. We can at anytime and for any reason, refuse to sell an item. All items listed for sale are viewable by all audiences, including those who are not registered users and those who are not 18 years of age. Users who do not follow these terms may be banned or held legally accountable. If a user sells an item on our site, Mybid domain.com will issue them a check within 14 business days for the final sale price, minus our fees. A copy of the receipt will accompany the check. Mybiddomain.com will correct any errors or mistakes as long as it is brought to our attention immediately and there is good cause to do so.
Disputes
Buyers rely on the description and pictures posted by Mybiddomain.com, to determine if they want to bid on an item. It is the sellers' responsibility to give Mybiddomain.com accurate, complete and honest descriptions of their items. Both buyer and seller are obligated to complete the transaction process. Mybiddomain.com understands that disputes may arise relating to the posting of items, the selling of items or the purchasing of items. It is up to the buyer or seller to come to Mybiddomain.com to settle any and all disputes, issues and concerns. In resolving any matter or disputes we have the right to enlist any legal or professional advice.
Warranty
All bids are final! All sales are final! All items are sold as is and with no warranty. Mybiddomain.com, its employees and its users disclaim any implied warranties of any kind, including those of title, merchantability, fitness for a particular purpose and non-infringement. The above disclaimer may not apply to everyone, as some states do not allow the disclaimer of implied warranties. Mybiddomain.com does not know the condition of any item and is not responsible if the item does not meet the buyers' standards or expectations. We may or may not know if an item is in working order. We do not guarantee the condition of any item. Buyers can not hold Mybiddomain.com or the seller responsible if an item does meet their expectations.
Release
Mybiddomain.com, its employees, or its users will not be held liable for any damages of any nature resulting from (1) the use of this site (2) the items sold on this site or (3) the contents thereof. We will not be held liable for any injuries to person or property resulting from (1) the use of this site (2) the items sold on this site or (3) the contents thereof. We will also not be held liable for any defects or any product liabilities on any items sold on this site. In addition, Mybiddomain.com, its employees or its users will not be liable for any damages (either monetary or physical) caused from or related to the use of or inability to use this website. The total liability of Mybiddomain.com to you for all damages, losses and causes of action arising from this agreement or your use of the site and the service, shall not exceed $100.00 one hundred U.S. dollars. Be aware that Mybiddomain.com may be unavailable at any time for site maintenance and updates. No person warrants that this site will be uninterrupted or error free. It is possible that this site may contain errors, outdated information, omissions and inaccuracies; we will do our best to prevent this from happening. Mybiddomain.com and its owners can make changes to the site at any time and without notice, including changes to fees, policies, terms and conditions, and site layout and content. Although they are required to we do not guarantee that our users will abide by the terms and conditions set forth in this agreement. We do not have any control over the quality, safety, or legality of the items bought or sold. We do not have any control over the truth or accuracy of the listings, the ability of the sellers to sell the items, or the ability of the buyers to buy the items. We cannot guarantee that a buyer or seller will complete a transaction. If you do not agree with and accept these terms and conditions do not use our site. Once a buyer picks up an item and pays for it they own it and are responsible for it, Mybiddomain.com and the seller are therefore released from ownership of the item.
Indemnity
You agree to defend, indemnify and hold harmless Mybiddomain.com and all of its affiliates from claims, demands, damages and losses both actual and consequential, known and unknown, suspected and unsuspected, disclosed and undisclosed arising from your breach or violation of this agreement and its contents, your breach or violation of this site and its contents or any disputes or damages caused from your use of this site.
Consent to suit in Michigan, Kent County
In the event of any legal proceedings arising from this contract or from the auction in connection therewith, buyers and sellers consent to being subject to the personal jurisdiction of the courts of the State of Michigan in Ottawa County. Furthermore all users agree that the laws of the State of Michigan shall govern this agreement and the users' transaction hereunder.
Privacy
We have the right to monitor all users accounts. We do not sell or distribute your personal information in any way to third parties. Your information is used strictly for Mybiddomain.com and is securely encrypted. We may use your information to perform surveys or request feedback aimed at improving our services. To close your account you must log out. Your password protects your account, make it easy to remember and keep it in a safe place. Your information is stored and processed on computers located only in the United States.
In addition to the terms and conditions set forth in the above agreement, the following is a list of conditions that must be adhered to by all of Mybiddomain.com's users:
Do not use our site if you are not competent, if you do not understand and agree to these and the above terms and conditions, or if you are not at least 18 years of age.
If selling an item you agree to have all sellers fees deducted from you sales price.
If purchasing an item you are entering into a legally binding contract. You must pick up and pay for your items within 5 business days from the close of auction.
Do not copy, change, delete, sell, distribute or infringe on, any copyrights, trademarks or patents.
You may not collect or attempt to collect any personal information from other users.
Do not violate any laws.
